Terms and Conditions
Last updated: October 2026
These terms govern your use of the Aghsan platform. By accessing or using our service, you agree to be bound by the terms below. Please read them carefully before using the platform.
1. Acceptance of Terms
By registering for or using the Aghsan platform («the Service»), operated by DAR AL AGHSAN TECHNOLOGIES L.L.C, a company established in Dubai, United Arab Emirates («Aghsan» or «we»), you («the Center» or «the User») agree to these Terms and Conditions in full. If you do not agree, you must not use the Service. These terms apply to all staff members, administrators, specialists, and any other users operating under your organization's account.
2. Description of Service
Aghsan is a cloud-based case-management platform designed for special needs centers. It provides tools for child file management, assessments, session documentation, goal tracking, appointments, report generation, billing, and a secure parent portal that can include messaging with the center when the center turns it on. The Service is provided on a subscription basis to registered organizations. The Center can turn off optional AI-assisted features, where available. They produce drafts only: a qualified specialist must review them, and clinical decisions remain the responsibility of the Center. The Service is a management and documentation tool and does not diagnose or make clinical decisions.
3. Account Registration and Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must ensure that all users added to your organization account are aware of and comply with these terms. You must promptly notify us of any unauthorized use of your account.
4. Permitted Use
The Service may be used solely for legitimate care-management purposes within your registered organization. You may not use the Service to store data unrelated to the children and families under your care, to engage in any unlawful activity, to attempt to gain unauthorized access to any part of the platform, or to reverse-engineer, copy, or redistribute any part of the Service.
5. Data Ownership and Responsibility
All child and family data entered into the platform remains the property of the Center. Aghsan acts as a data processor on your behalf and does not claim ownership of your data. You are responsible for ensuring that data you enter is accurate, lawfully obtained, and handled in accordance with applicable privacy laws, including the UAE Personal Data Protection Law, which Aghsan follows as a company established in Dubai. You remain responsible for any other laws that apply where your Center operates, and for agreeing with parents and guardians that they will receive notifications, including through the parent portal and WhatsApp.
6. Subscription and Payment
Access to the Service requires an active subscription. Subscription fees are billed in advance on the agreed billing cycle. Failure to pay may result in suspension of access. All fees are non-refundable except where required by law or as otherwise specified in your subscription agreement. Prices may be updated with at least 30 days' notice. Fees are charged in the local currency of the country where the Center operates and can be paid through Stripe, Tap Payments, or bank transfer, depending on the country.
7. Intellectual Property
All intellectual property rights in the Aghsan platform, including its software, design, documentation, and branding, are owned by or licensed to Aghsan. You are granted a limited, non-exclusive, non-transferable licence to use the Service during your active subscription period. This licence does not include the right to copy, modify, distribute, or create derivative works.
8. Availability and Maintenance
We aim to maintain high platform availability but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance where possible. We reserve the right to modify or discontinue features with reasonable notice. We are not liable for any loss resulting from temporary unavailability of the Service.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Aghsan is not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability for any claim arising under these terms shall not exceed the fees you paid in the three months preceding the claim.
10. Termination
Either party may terminate the subscription agreement with written notice as specified in the subscription agreement. Upon termination, your access to the Service will be deactivated. You will have a reasonable period to export your data before it is permanently deleted from our systems, in accordance with our data-retention policy.
11. Governing Law
These terms are governed by the laws of the United Arab Emirates. Any disputes shall first be resolved through good-faith negotiation. If unresolved, disputes shall be referred to the competent courts of the UAE.
12. Changes to These Terms
We may update these terms from time to time. We will notify active centers of material changes by email or in-app notice at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated terms.
